In Breach of Enduring Power of Attorney?

My brother in law has power of attorney over my Father in law. My Father in law has recently been placed in a home - not sure if he has Alzheimer's but in any event doesn't really have a grip on reality and is unable to handle his affairs.

We have discovered that my brother in law is planning to move into his father's now empty house and is intending to let his own property. I'm fairly certain that his father's affairs are set up such that everything is paid by DDM from his accounts and knowing my brother in law he'll just leave them be and let my father in law fund his life.

My question is - surely this is classed as theft under the power of attorney regulations? it certainly seems to be an abuse of his position. Assuming it is - what can we do about it?
